Terms of Service

These Terms of Service (“Terms”) govern your access to and use of HisabConnect, a workforce attendance and payroll management platform (the “Service”), operated by Hisabconnect Technologies Private Limited (“HisabConnect”, “we”, “us”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By registering for or using HisabConnect — whether as a Business Owner, an invited staff member, or an employee using the self-service portal — you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
2. Description of the Service
HisabConnect lets a Business Owner digitally track employee attendance, calculate salaries (monthly or daily-wage based), record advances and payments, maintain a running balance per employee, generate payroll reports, and optionally grant employees read-only self-service access to their own records. The Service is provided as a software tool to assist with these tasks — it does not replace your own obligations as an employer under applicable law (see Section 11).
3. Eligibility & Account Registration
- You must be at least 18 years old and capable of entering into a binding contract under Indian law to create an account.
- Accounts are created using a valid mobile phone number, verified via a one-time passcode (OTP). You are responsible for maintaining control of that phone number and for all activity that occurs under your account.
- You agree to provide accurate information and to keep it up to date.
- You may not create an account on behalf of someone else without their authorization, and you may not use another person's phone number to register.
4. Business Owner Responsibilities
If you register a business on HisabConnect, you (the “Business Owner”) are solely responsible for:
- The accuracy and legality of all employee, attendance, and salary data you or your staff enter into the platform;
- Obtaining any consents or providing any notices to your employees that you are required to provide under applicable labour, employment, or data protection law before entering their personal data into HisabConnect;
- Complying with all applicable statutory obligations as an employer, including but not limited to the Payment of Wages Act, Minimum Wages Act, Provident Fund and ESI regulations, and any state-specific shops & establishments or labour laws that apply to your business;
- Reviewing and verifying salary calculations before disbursing actual payments to employees — HisabConnect is a calculation and record-keeping aid, not a certified statutory payroll compliance system, and you remain responsible for the final accuracy and legality of amounts you pay;
- Controlling which staff members have access to your business data, and the permissions granted to each;
- Any actions taken by staff members you have invited to your business.
5. Staff & Employee Accounts
A Business Owner may invite staff members to help manage their business, with permissions the owner controls and can revoke at any time. A Business Owner may also enable self-service access for individual employees, allowing them to view (but not edit) their own attendance, balance, and salary slip history. Staff and employee accounts are subject to these same Terms. HisabConnect is not a party to, and assumes no responsibility for, the underlying employment relationship between a Business Owner and their staff or employees.
6. Subscriptions, Billing & Refunds
HisabConnect offers a free tier and paid subscription plans with higher employee limits and additional features, as described on our pricing page. At present, paid subscriptions are activated manually by our team after you contact us; self-serve online payment is not yet available and will be governed by updated terms (including a formal refund policy) once introduced.
- Subscription plans, pricing, and included limits (such as maximum employees) are as displayed on our website or as communicated to you at the time of purchase, and may change with reasonable notice for future billing periods.
- Fees already paid for a subscription period are generally non-refundable, except where required by law or at our discretion in cases of a demonstrable service failure on our part.
- If your subscription lapses or is not renewed, your access to paid features may be restricted, though your data is retained and access is restored upon renewal (subject to Section 13 on prolonged inactivity).
- We reserve the right to suspend accounts with significant, unresolved overdue payment after reasonable notice.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose, or to store or process data you do not have the legal right to process;
- Attempt to gain unauthorized access to another business's data or another user's account;
- Interfere with, disrupt, or attempt to circumvent the security, rate-limiting, or access-control mechanisms of the Service;
- Use automated means to abuse our OTP/SMS system or otherwise generate excessive load on the Service;
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
- Resell, sublicense, or provide the Service to third parties as your own product without our written permission.
8. Data Ownership
As between you and HisabConnect, you (the Business Owner) retain all ownership rights to the business and employee data you enter into the Service. We do not claim ownership of your data and will only process it to provide the Service to you, as described in our Privacy Policy. You may request an export or deletion of your data at any time, subject to Section 9 of our Privacy Policy.
9. Intellectual Property
The HisabConnect name, logo, software, design, and all underlying technology are the property of HisabConnect and are protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, branding, or proprietary technology except as necessary to use the Service as intended.
10. Service Availability & Changes
We aim to keep HisabConnect available and reliable, but we do not guarantee uninterrupted or error-free operation, and we do not currently commit to a specific uptime service-level agreement. We may modify, add, or remove features from the Service from time to time, and we will use reasonable efforts to communicate significant changes that materially affect how you use the Service.
11. Disclaimers & Limitation of Liability
HisabConnect is provided on an “as is” and “as available” basis. Salary and wage calculations performed by the Service are based entirely on the attendance data, rates, and settings you configure — we do not independently verify their accuracy or their compliance with any statutory wage, tax, or labour requirement. You are responsible for reviewing calculated amounts before making any actual payment to an employee.
To the maximum extent permitted by applicable law, HisabConnect and its officers, employees, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim, or ₹5,000, whichever is greater. Nothing in these Terms limits any liability that cannot be limited under applicable Indian law.
12. Indemnification
You agree to indemnify and hold harmless HisabConnect and its officers and employees from any claim, demand, loss, or damage, including reasonable legal fees, arising out of: (a) your violation of these Terms; (b) your violation of any law or the rights of a third party, including any employee whose data you process using the Service; or (c) any dispute between you and your employees or staff relating to attendance, wages, or amounts calculated or recorded using the Service.
13. Suspension & Termination
- You may stop using the Service and request deletion of your account at any time by contacting us.
- We may suspend or terminate your access if you violate these Terms, engage in abusive or unlawful use of the Service, or fail to pay applicable subscription fees after notice.
- We may suspend a business account while we investigate a suspected violation; suspension blocks further use of the Service but does not delete your data, which remains recoverable upon resolution.
- Upon termination, your right to use the Service ends immediately; provisions of these Terms that by their nature should survive termination (including Sections 8, 11, 12, and 14) will continue to apply.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to applicable law, any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at Surat, Gujarat, India. We encourage you to contact us first at support@hisabconnect.in so we can try to resolve any concern informally before pursuing formal proceedings.
15. Changes to These Terms
We may update these Terms from time to time. We will update the “Last updated” date above and, for material changes, provide additional notice before the change takes effect. Continued use of the Service after a change takes effect constitutes your acceptance of the revised Terms.
